Elizabeth is a senior dispute resolution solicitor who joined Harper James in September 2022.
Elizabeth qualified as a solicitor in 2002 and advises businesses of varying sizes on dispute evaluation and resolution by litigation, negotiation, mediation or other alternative dispute resolution process. Her practice includes advising on a broad range of disputes including breach of contract claims, claims arising from commercial supply and distribution agreements, warranty claims and she has significant expertise in pursuing partnership/shareholder disputes.
In recent years my practice has been focused on shareholder disputes which has given me a wealth of experience in the area. I recognise that every shareholder dispute is different and work closely with clients to identify the issues which arise in each case, provide strategic advice and explore the possibility of avoiding court action through the negotiation of an amicable compromise where possible, to enable the parties to move forwards.
Some of her key cases include:
- Acting for a specialist provider of facilities for adults with neurological injuries and conditions in connection with a claim against two former directors for, amongst other things, breach of directors' duties and misappropriation of company funds.
- Representing a limited company in pursuing a claim against its former auditors for negligence/breach of contract and/or duty.
- Acting on behalf of a limited company in proceedings against a former employee for breach of contract arising from the misuse of confidential information and/or trade secrets.
- Defending a company director in proceedings being brought by a bank to enforce the terms of the director's personal guarantee (and successfully defeating the bank's application for summary judgment).
- Acting for a shareholder in connection with a claim for unpaid dividends and subsequent unfair prejudice proceedings.
Elizabeth is known for her pragmatic and common sense approach and seeks to resolve her clients' disputes in a timely, commercial and cost-effective manner. She has a practical and approachable style and a keen eye for detail.
Elizabeth trained and qualified as a solicitor at DLA Piper. She remained at DLA Piper until 2008 and has since worked for niche commercial practices Taylors and Baines Wilson LLP. Elizabeth was a partner and headed-up the dispute resolution practice at Baines Wilson for six years.
Elizabeth is married with two sons and much of her free time revolves around football training, football matches and dog walking.
