Michael Key

Michael is an experienced dispute resolution partner who qualified in 1998. He helps businesses resolve complex commercial and contractual disputes strategically and cost-effectively, always focusing on the best commercial outcome rather than pursuing litigation for its own sake.

Michael understands how quickly disputes can become expensive, disruptive and time-consuming. He works closely with clients to establish their objectives at an early stage, assess the legal and commercial risks realistically, and identify the most appropriate route to resolution.

Known for his practical and commercially focused advice, Michael takes a robust approach when necessary. He is equally prepared to recommend a tactical concession or alternative form of dispute resolution where this could reduce costs, limit risk or avoid unnecessary management distraction.

Michael advises on a broad range of contractual disputes, debt recovery and enforcement proceedings. He has particular experience in construction and engineering disputes, supported by an MSc in Construction and Arbitration Law in addition to his law degree.

His experience extends across litigation, mediation, adjudication, arbitration and expert determination. This allows him to recommend the process best suited to each client’s commercial objectives, timescales and appetite for risk.

Work highlights include:

• Acting in an arbitration concerning the final account under a JCT construction contract.
• Advising on professional negligence and breach of contract claims involving utility connection designers and project managers.
• Pursuing and defending claims relating to defective building products, defective workmanship and disputes over the extent of contractual obligations.
• Pursuing and defending adjudications under the Housing Grants, Construction and Regeneration Act 1996, including disputes concerning unpaid payment applications.
• Acting in proceedings under the Construction Plant Hire Association Model Conditions.
• Pursuing and defending winding-up petitions and pursuing bankruptcy petitions.
• Successfully obtaining summary judgment for unpaid debts, helping clients avoid the cost and delay of a full trial.
• Advising on the termination of commercial agreements and the resulting contractual claims.

Outside work, Michael enjoys cycling in the hills, going to the gym and following Huddersfield Town, while continuing to hope for their next promotion. He lives with his wife and has two nearly grown-up daughters who keep them both busy.
