Online Brand Protection

Protect your brand’s reputation online by monitoring for unauthorised use

You’ve worked hard to create a strong, recognisable brand which sets your business apart from competitors, inspires consumer trust and encourages loyalty, so it must be protected against impersonation.

Our brand monitoring service proactively protects your brand online by monitoring e-commerce marketplaces, social media platforms and web results for any unauthorised use.

If we identify any misuse of your brand, we will take decisive action to remove the offending listings, webpages or social media posts and stem any brand damage.

How does the brand protection service work?

Our intellectual property solicitors combine cutting-edge brand monitoring software with their legal expertise to set up your bespoke monitor. You can select one or several options from the following:

E-commerce monitoring

Proactively detects and identifies any misuse of your brand online, including by counterfeiters, across the world’s leading marketplaces such as Amazon, eBay, Etsy, Alibaba and more.

Social media monitoring

Automatically records mentions of your brand across the most popular social media platforms, including YouTube, LinkedIn, Facebook, TikTok and Instagram.

Website monitoring

Identifies any websites that mention your brand so you can investigate if you brand name has been used appropriately.

Our monitoring software alerts us to any potential infringement of your intellectual property rights online. Based on our expertise, we filter out irrelevant reports and only notify you of genuine issues that pose a risk to your business.

If we discover any infringing act that we believe may damage your brand, we will work with you to stop the activity and ensure it is not repeated in the future. Sometimes, this involves litigation but, often, issues are quickly resolved by either issuing a takedown notice or sending a cease-and-desist letter.

Our solicitors’ time spent reporting the issue and taking any action relating to the infringement is billed at the hourly rate applicable under your plan.

The monitoring software licence fee will cost between £70 – £200 per month depending on what you would like to monitor. If you would like to sign up for the service you will need to pay for the first month’s licence fee up front and commit to a minimum initial term of three months. The service will then automatically renew on a month-to-month basis.

What are the benefits of protecting your brand online?

Brand monitoring software is an invaluable tool in your armoury. It can help you to protect your brand in a number of ways, including:

Early warning detection

Identifies any counterfeit goods or other misuse of your brand early on, so you can take swift action to protect your reputation and safeguard your profitability.

Preventing infringements going unnoticed

Monitors all major marketplaces, social media platforms and the web, so you can be confident that your brand is fully protected at all times, and no infringements will slip under the radar.

Providing real-time insights

Detailed reporting includes information on the source and nature of the infringement. Our intellectual property solicitors will use this information to formulate a plan to stop the infringement. Our approach will consider the impact the infringement has on your business, your financial position and your attitude to risk.

Why you should trust Harper James to protect your brand

We understand how frustrating it can be for brand owners that feel their legitimate concerns over misuse of their brands are ignored by the major social media and ecommerce platforms.

Our intellectual property solicitors not only have a deep understanding of intellectual property law but also a clear understanding of how these platforms work. We know from experience that the major platforms and websites will often ignore standard forms of communication.

Having a legal representative by your side will make it clear to the platforms and the infringers that you are serious about enforcing your intellectual property rights and that you are not afraid to take legal action if necessary. This is often enough to convince the platforms and websites to take down the infringing material.
