James Borshell

Senior Employee Incentives Solicitor

James Borshell is a Senior Employee Incentives Solicitor at Harper James, supporting the employee incentives team. He qualified as a solicitor in 2002 and advises on employee incentives and employee benefits matters, including option plans, growth shares, long term incentive plans, bonus schemes, pensions and healthcare trusts.

Prior to joining Harper James, he was a partner at Knights and Womble Bond Dickinson, and in between corporate legal work spent five years working in the Government Legal Service at the DWP/DH Solicitor’s office drafting pension regulations, and advising the Secretary of State on primary legislation including the Civil Partnerships Act and the Pensions Act 2004.

James advises on the set up, maintenance and vesting of tax efficient incentive option and share schemes, liaising with regulatory authorities such as HMRC and defined benefit and defined contribution pension scheme issues of all kinds, from pensions ombudsman disputes all the way through to complex funding structures and clearance applications. He has advised on the benefits issues associated with transactions up to £5bn in value and those involving complex statutory frameworks and across multiple jurisdictions.

When he’s not working with the HJ team, James works on clinical research contracts, writes dystopian novels under a pen-name, and enjoys a spot of fishing whilst watching for bears on the Last Frontier.
